Terms of Participation and Payment Terms

NCQA hosts/provides certain events and programs (the “Program(s)”). Participation in the Programs is subject to these Terms of Participation (“Agreement”). By registering and joining a Program, you accept and agree to this Agreement and applicable terms and conditions, policies or disclaimers referenced herein. We encourage you to read this Agreement carefully. YOU MAY NOT REGISTER OR JOIN IN A NCQA PROGRAM IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT.

BY REGISTERING AND/OR USING THE PROGRAM(S), YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

COVID-19 NOTICE

NCQA intends to hold in person programs. All in-person attendees will need to provide proof of full vaccination status (as will be defined closer to the event date) against COVID-19 and may be required to provide evidence of a negative COVID-19 test. NCQA is committed to adhering to all federal and state laws, and is closely monitoring federal, state, and local government guidelines, including around masking and social distancing. The safety of our staff, speakers and guests is our top priority. More information will be provided closer to the event.

As NCQA resumes in-person events in furtherance of our mission, the health and safety of all persons present at/during in-person events remains a top priority. To that end, NCQA has instituted health and safety protocols around COVID-19. Although attendees should recognize and accept there is inherent risk involved in attending in-person events, NCQA has adopted risk-mitigation measures to reduce the potential exposure and transmission of COVID-19. The below “NCQA COVID-19 Guidelines for In-Person Events” document provides detail on the requirement to be fully vaccinated as defined by NCQA policy to attend in person events and describes relevant health protocols and attendee responsibilities. PROGRAM MATERIALS/COPYRIGHT

Program materials are owned and copyrighted by NCQA. Any distribution of program materials or use of program materials outside a personal, non-commercial purpose by attendees is strictly prohibited. NCQA does not sell or provide additional copies of Program materials.

RECORDING

The use of recording devices during a Program is prohibited.

USE OF NAME/IMAGE AND AUDIO/VISUAL RELEASE

By participating in a Program, you agree that NCQA may use your image or likeness (including but not limited to, motion picture, photograph, slide film, digital image, digital video recording and/or videotape), audio recording and name.

You also grant NCQA authority to video and/or audio record and transcribe the Program for reproduction and use in future Programs. NCQA will own all rights, title, including copyright, in the finished recording and any publication of the Program and future materials.

DISCLAIMER

THE PROGRAMS ARE PROVIDED “AS IS.” NCQA MAKES NO WARRANTY TO YOU, EXPRESS OR IMPLIED, WITH RESPECT TO INFORMATION OR MATERIALS DELIVERED PURSUANT TO THIS AGREEMENT OR ANY PROGRAM, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ANY WARRANTY THAT THE PROGRAM WILL BE FREE FROM INFRINGEMENT OF PATENTS, COPYRIGHTS, TRADEMARKS, TRADE SECRETS OR OTHER RIGHTS OF THIRD PARTIES AND ANY WARRANTY AS TO THE ACCURACY QUALITY, RELIABILITY, SUITABILITY, COMPLETENESS, TRUTHFULNESS, USEFULNESS, OR EFFECTIVENESS OF THE PROGRAM.

INDEMNITY

You shall indemnify and hold harmless NCQA and its directors, officers and employees from and against any and all liability, loss, cost, expense (including reasonable attorney fees), damage, or claim (“Losses”) arising out of a third-party claim made or brought against NCQA relating to your participation in a Program or breach of this Agreement. With respect to any and all claims brought by a third party, you shall promptly notify NCQA of such claim.

LIMITATION OF LIABILITY

THE LIABILITY OF NCQA SHALL OTHERWISE BE LIMITED TO ACTUAL AND DIRECT DAMAGES, NOT TO EXCEED $1,000.

If choosing to attend an event in person, your registration constitutes full assumption of any risks associated with COVID-19. NCQA AND ITS PERSONNEL SHALL NOT BE RESPONSIBLE OR LIABLE TO YOU, YOUR EMPLOYER OR ANY THIRD PARTY FOR ANY PERSONAL OR BODILY INJURY ARISING FROM OR RELATED TO COVID-19, INCLUDING, BUT NOT LIMITED TO, DEATH.

YOUR LIABILITY TO NCQA ARISING UNDER THIS AGREEMENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE SHALL BE LIMITED TO ACTUAL AND DIRECT DAMAGES. YOU SHALL HAVE NO LIABILITY FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING UNDER OR RELATED TO THIS AGREEMENT, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ACCORDINGLY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

NCQA PROGRAM CANCELLATION

In the event that an NCQA Program is cancelled, NCQA is not responsible for airfare, hotel accommodations and/or other incurred costs.

LEARNING MANAGEMENT SYSTEM (AS APPLICABLE)

NCQA employs a Learning Management System (LMS) to facilitate the Programs. You must register and open a LMS account, completing the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a username. You are responsible for keeping your account information and password confidential and are responsible for all activity that occurs under your account. You are prohibited from sharing your LMS account with anyone. You agree to notify NCQA without delay of any unauthorized use of your account or any other breach of security. Unauthorized users of NCQA webinars may be subject to appropriate fees.

ACCESS AND ACCOMMODATIONS

Please submit disability accommodation and other special requests through my.ncqa.org at least 14 business days before the event.

HOTEL ACCOMMODATIONS

After you receive confirmation, contact the facility where the seminar will be held to reserve your room. See individual seminar descriptions for location and contact information. We strongly recommend that you make reservations early; rooms and rates are based on facility availability. NCQA does not validate or reimburse for seminar parking. NCQA LOCATION

NCQA offices are located at 1100 13th Street NW, Third Floor, Washington, DC 20005.

DRESS

Casual business attire is appropriate. Meeting rooms tend to be cool. We recommend that you bring a sweater or light jacket.

Payment Terms

NCQA’s Education and Training Programs (the “Program(s)”) are subject to these Education and Training Program Payment Terms (“Terms”). By registering and joining a Program, you accept and agree to these Terms. We encourage you to read the Terms carefully. YOU MAY NOT REGISTER OR JOIN IN THE NCQA PROGRAMS IF YOU DO NOT AGREE TO THESE TERMS. BY REGISTERING AND/OR USING THE PROGRAM(S), YOU AGREE TO BE BOUND BY THESE PAYMENT TERMS.

REGISTRATION AND PAYMENT

Payment in full is required to process your registration. Register online and pay with a credit card or by eCheck. For payments by check, navigate to the desired event in the NCQA Education LMS (education.ncqa.org), click the register button, add the course to your cart, and checkout. On the checkout screen, select the Pay Later option. You will receive an email with an invoice and instructions to pay by check.

MULTI-USER REGISTRATION

You may register multiple learners for an event using multi-user registration. To do so, navigate to the course page in the NCQA learning management system, click the Register tab, then click the link to register multiple participants. This option allows users to register multiple participants with one payment method. To register multiple participants with separate payments, users should use a separate individual or multi-user registration per payment method.

REGISTRATION AND CONFIRMATION

You will receive an e-mail confirmation when your registration has been processed. Do not make nonrefundable travel and hotel arrangements until you receive confirmation. 

SUBSTITUTIONS

If you have registered for a Program and are unable to attend, you may designate a substitute registrant from your organization. To do so, log-in to the NCQA Education LMS (education.ncqa.org), navigate to the event you wish to substitute out of (My Account >> My Courses >> Pending Activities), and click the substitution request link on the “Take Course” tab. You will be prompted to enter the information of the learner who will be taking your place. Substitution requests must be made before the first day of the Program. We will send a confirmation e-mail to the substitute registrant within one-two business days.

PROGRAM TRANSFER

If you cannot attend a Program you have registered for, you may transfer your registration fee to another open NCQA Program (space permitting). To do so, log-in to the NCQA Education LMS (education.ncqa.org), navigate to the event you wish to transfer out of (My Account >> My Courses >> Pending Activities), and click the transfer request link on the “Take Course” tab. You will be prompted to select the course you wish to transfer out of and enter information on the course you wish to transfer into. Transfer requests must be made at least 10 days before the start of the Program. There is a $150 processing fee. Program selection must be made at the time of the transfer. Transfers may be made once only. NCQA cannot honor transfer request for online programs, special events and conferences. You will receive a confirmation e-mail within two business days. Do not make nonrefundable travel and hotel arrangements until you receive confirmation.

PROGRAM AND WEBINAR CANCELLATIONS/REFUNDS

If you cannot attend a Program or a live webinar for which you are registered, you may request a refund. To do so, log-in to the NCQA Education LMS (education.ncqa.org), navigate to the event you wish to cancel (My Account >> My Courses >> Pending Activities), and click the cancel request link on the “Take Course” tab. You will be prompted to select the course you wish to cancel.

Registrants who cancel more than 10 business days before a Program are entitled to a refund of the registration fee paid minus a processing fee. The processing fee is $150.00, except in the case of single live webinars, which shall incur a $25.00 processing fee.

No refund will be given for on-demand eLearning events or for cancellations less than 10 business days prior to the start of a Program. Cancellation and refund policies are subject to change.

NCQA PROGRAM CANCELLATION

If an NCQA Program is cancelled, NCQA is not responsible for airfare, hotel accommodations and/or other incurred costs.

DISCOUNTS

Discounts must be requested at the time of purchase and cannot be applied retroactively or combined. If more than one discount applies, the greater discount will be given. Discounts may not be used for onsite Programs.

CCE Team Discount: When a CCE registers at the full price for a live CCE Quarterly Webinar, one or more CCEs from the same organization are eligible to receive a discount when they register for the same webinar. Submit requests through my.ncqa.org after the first CCE registers at the full price. Include the name and email address for all CCEs who want to register at the discounted rate; NCQA will email a discount code. Requests must be made at least 24 hours before the posted webinar start time.

Early Bird: Early bird discounts are applied automatically at checkout for eligible events. Use the “Find Possible Discounts” button to refresh available discounts after changing/adding registration information on the checkout page.

Government: Employees of federal, state and local governments receive a 25% discount. The discount is applied automatically at checkout for eligible learners with a .gov, .mil or .us email address. Use the “Find Possible Discounts” button to refresh available discounts after changing/adding registration information on the checkout page.

Other government employees: E-mail a letter on agency letterhead to conference@ncqa.org, or fax it to 202-955-3531, stating that you are a federal, state or local government employee. The letter must be received before you register for an event. The discount is not retroactive.

HEDIS Users Group: Members of the NCQA HEDIS Users Group receive vouchers for discounts on NCQA Programs. Voucher criteria and discounts may vary and must be redeemed at enrollment. Vouchers may not be used for onsite training. Contact us through my.ncqa.org with questions or to request your discount.

Team: Register three or more individuals from your organization at the same time, for the same Program, with one payment method, and each will receive a 15% discount. To apply the discount, use the multi-user registration link on the course registration page. The 15% discount will be applied automatically at checkout.

Note: If one or more registrant cancels before the Program, the 15% discount will no longer apply, and each remaining registrant must pay the 15% difference before the start of the Program.
